Abstract

This study delves into public governance, examining how it can enhance efficiency in the management of public contracts, with a particular focus on Brazil’s New Public Procurement Law (Law No. 14.133/2021). The premise is that the way the public sector contracts services and goods is crucial to the effective delivery of public policies. In the absence of effective governance mechanisms, the legality, cost-efficiency, and legitimacy of state actions may be compromised. The central question is: how can governance be effectively implemented to monitor and improve the efficiency of public contracts, especially in a context of digital transformation and new legal requirements? The hypothesis is that adopting well-structured governance practices—based on efficiency, transparency, and integrity—can significantly improve bidding processes and reduce legal and administrative risks. The general objective is to investigate the legal and practical foundations of governance in contemporary public administration and how they relate to the tools provided by the new legislation. The study adopts a qualitative approach, combining literature review with the analysis of legal documents, technical guidelines, and real-world experiences from the State of Alagoas regarding the regulation of the new law. Preliminary findings indicate that governance is far from an abstract concept; it requires a solid organizational structure, segregation of duties, strategic planning, clear performance indicators, and integration with digital control systems. The analysis also addresses current regulatory challenges, especially the digitization of procurement and the use of real-time monitoring technologies. In conclusion, public governance, when aligned with digital transformation, has the potential to drive a new regulatory model: more efficient, agile, and genuinely committed to sustainable development.
