Abstract

The advancement of technology and the consolidation of a hyperconnected culture have significantly transformed family dynamics, especially with regard to parenting. In this context, the concept of digital abandonment emerges, characterized by the absence of mediation, guidance, and emotional bonding between guardians and children or adolescents in the virtual environment. Unlike physical abandonment, digital abandonment occurs even when there is daily coexistence, manifesting as negligence regarding the use of electronic devices, social media, and the exposure of personal data.

This study is based on the hypothesis that digital abandonment constitutes a contemporary form of parental omission, which may harm the emotional, social, and cognitive development of children and adolescents. The central research question is: how can digital abandonment be characterized as a violation of the duty of care and protection within the scope of Family Law, considering that both the Federal Constitution, the Civil Code, and the Child and Adolescent Statute establish a broad protective framework, as well as duties related to parental responsibility and family authority?

The general objective is to analyze the impacts of digital abandonment on parental relationships and to discuss possible legal and social instruments for its prevention and confrontation. The study adopts the deductive method, with a qualitative approach and an interdisciplinary literature review, drawing from Family Law, Sociology, and Psychology. It seeks to contribute to a critical reflection on the role of parents and guardians in the digital upbringing of their children, emphasizing the importance of emotional presence in the virtual environment as well.

The conclusion is that, given the centrality of technology in contemporary life, parenting must be redefined to incorporate digital care and education as essential elements of family life and the responsible exercise of parental authority.
