A IMPLEMENTAÇÃO DE POLÍTICAS PÚBLICAS QUE VISA COIBIR A VIOLÊNCIA DOMÉSTICA E FAMILIAR E O ART. 8º DA LEI MARIA DA PENHA

Abstract

This work analyzes Article 8 of the Maria da Penha Law, which defines public policies that aim
to curb domestic and family violence against women. Note that the creation of some equipment
such as the Special Court; social assistance (shelter houses, health); devices such as
electronic ankle bracelets and buttons with cell phone technologies and applications,
Maria da Penha patrols were advances that helped save the lives of many women, however, they
have not yet stopped the increase in violence rates, according to the Brazilian Public Security

Yearbook , and questions why 17 years of the Maria da Penha Law (LMP) were not enough to
implement these formulated policies? The work is characterized as bibliographical research such
as: books, articles, websites and the deductive method of a qualitative nature. This article
offers some reflections aiming to increase the analysis potential of this legal provision,
in parallel with the elements and models for implementing and improving public policies, aiming
to contribute to overcoming the worrying scenario of gender violence and is based on the
premise of that we have already gone beyond the “agenda and formulation” phases, making it
necessary to focus efforts on the “implementation and evaluation” phase of the policies
enshrined in the LMP with an emphasis on “intersectorality” and “intersectionality”.
The assessment and management of risk for situations of violence is an intense use of the
prevention of femicides in specific cases, but humanized education is a fundamental path to
dissolving patriarchal culture and proves to be a call for preventing violence in general.
The research concludes that it is necessary to put into practice the determinations established
by Law No. 11,340/2006 and promote the implementation of these public policies that depend on
the state's instruments of action, the participation of different government agents and civil
society, the mechanisms appropriate to carry out its implementation, as well as the evaluation
phase, as it was found that several measures were adopted and some equipment exists in large
cities, but they function precariously and do not cover the quantity and sufficient expansion
that guarantee women security and a life free from violence and discrimination.
