THE IMPLEMENTATION OF THE BLOCKCHAIN NETWORK TO THE REAL ESTATE REGISTRATIONS

The present work aims to analyze the impacts resulting from the evolution of technologies and the impact that this can cause in society. It is important to discuss the blockchain network for property registration, because, although the technology is innovative, Brazilian legislation does not have regulation on the case, which encompasses the acquisition of real estate property, as well as its respective rights, through digital means. In this sense, despite the lack of legislation on the technology, the use of blockchain can be an advance for the debureaucratization of the real estate system in Brazil. This is because the transactions recorded on the network make up a digital list of data records, serving as an immutable and irreversible timeline, which ensures that no data is lost, so that all members can verify the chronological order and veracity of the records. Thus, a study is proposed that points out, in the contemporary context, the limits and possibilities of using a blockchain network developed by the Public Power, through legal/normative regulation of the registry system, with transactions operated through technology that validate the negotiations registered by real estate notaries that are part of the network, as well as the storage of data and the procedure of acquisition of real estate property. The methodology used to carry out this work is deductive, embodied in the analysis of legal, constitutional and infra-constitutional norms, positions doctrinal and jurisprudence of the state and higher courts and scientific articles, to point out a comparative result, as well as a conclusive analysis of the case.
