Abstract

The research investigates the problem of insurance and compensatory funds in Civil Liability for damage caused by (AI) Artificial Intelligence. And as objectives, it aims to present mandatory insurance and compensatory funds from the European Parliament Resolution 2020/2014. This is an exploratory study and literature review and to carry out the work the scientific method of approach, hypothetical-deductive, will be used. In the mandatory insurance model, the potential agents involved in the AI development chain are considered, who will contribute with security according to the level of involvement, both technical and economic in the development of AI. In conclusion, mandatory insurance and compensatory funds have been consolidated as a satisfactory solution in the experience of some European countries, according to the European Parliament Resolution 2020/2014, but different realities must be taken into account, when compared to Brazil, because, even if Brazil does not have a specific law, but only a PL 21/20, under discussion, there is the Brazilian Civil Code, which in art. 927, sole paragraph, brings the general clause of objective civil liability due to the risks.
