DIGITAL SURVEILLANCE AND PANDEMIC

Faced with the COVID-19 pandemic and the adoption of means of sanitary control by States, in a global perspective, this essay is developed in order to question the limits of state control regarding personal data, using Law and Literature as a methodology, in an analysis of the novel “Corpus Delicti: A process”, by the german author Juli Zeh. In the dystopia presented in the novel, there are clear points of intercession that resemble the reality experienced in times of pandemic, including reflecting on the legal norm that allows the State to interfere in the lives of individuals in order to guarantee the health of all, to the detriment of others. collective rights important to citizens. The reflection on the limits of state control in a health crisis, in addition to being current, points out some problems such as the law as a legal instrument for the legitimation of acts that, not always, aim at the common good. Thus, thinking about the similarities of the literary state dystopia and the practices carried out in a health emergency situation contribute so that, in similar cases that may happen, excesses can be avoided so that fundamental rights are duly guaranteed.
